S. 2649 — Psychiatric Hospital Inspection Transparency Act of 2025

This section amends SSA §1865 (42 U.S.C. 1395bb) to (1) expand deeming authority for compliance with Medicare conditions of participation to include hospitals and psychiatric hospitals (i.e., Medicare-certified facilities or distinct parts thereof exclusively providing inpatient psychiatric services) beginning two years after enactment of the Psychiatric Hospital Inspection Transparency Act of 2025; and (2) require national accreditation bodies, beginning two years after enactment, to include Form CMS–2567 (i.e., Statement of Deficiencies and Plan of Correction, or successor form developed by the Secretary) in accreditation surveys of such providers, along with additional appropriate information. The section also amends SSA §1866 (42 U.S.C. 1395cc) to require the Secretary, beginning two years after enactment, to publish appropriate certification or accreditation survey information for psychiatric hospitals on the CMS Care Compare website (or successor), with timely updates, as determined in consultation with stakeholders and in compliance with HIPAA privacy regulations (Thus, the information must not identify patients or individual providers and must enable informed consumer decisions on psychiatric care.).
