S. 2666 — Foreign Robocall Elimination Act

This section establishes a Taskforce on Unlawful Robocalls (i.e., calls violating 47 U.S.C. 227(b) or (e)) not later than 270 days after enactment, to be led by the Federal Communications Commission (FCC) after consultation with the Federal Trade Commission (FTC) and the Attorney General. The taskforce comprises (1) representatives from federal agencies deemed appropriate by the FCC Chair (in consultation with the FTC Chair and Attorney General), appointed based on agency head recommendations; and (2) seven private sector representatives jointly appointed by the FCC Chair, FTC Chair, and Attorney General (notwithstanding FACA, 5 U.S.C. ch. 10), including three experts in combating unlawful robocalls (e.g., voice service providers, analytics providers, technologists), one from the TRACED Act consortium, one from a telephone-marketing business, one from a non-marketing telephone-communicating business or nonprofit, and one customer advocate with relevant expertise (with fallback appointment authority to the FCC Chair if no agreement, subject to Commission notice and majority vote requirements absent prolonged vacancies). The taskforce must prepare a report for relevant federal agencies and Congress with recommendations on combating foreign-originated unlawful robocalls into the United States, studying matters such as domestic versus foreign volumes, top originating countries, financial and identity theft losses, caller ID authentication technology adoption abroad, international collaboration options, technical solution improvements (e.g., STIR/SHAKEN adequacy for foreign calls), and related issues.
