This section modifies U.S. Customs and Border Protection (CBP) authority to share information on merchandise reasonably suspected of infringing recorded trademarks or copyrights (i.e., counterfeits under 19 U.S.C. 1526 or pirated goods or circumvention devices under 17 U.S.C. 602, 1201(a)(2), or 1201(b)(1)) with intellectual property rights holders by (1) raising the threshold from "suspects" to "has a reasonable suspicion"; (2) expanding required information and unredacted images to cover packing materials and shipping containers (in addition to merchandise, packaging, and labels); (3) authorizing CBP to provide nonpublic information about the merchandise generated by and obtained from online marketplaces, express consignment operators, freight forwarders, or other entities involved in its sale or importation; and (4) expanding eligible recipients beyond rights holders to include any other party with an interest in the merchandise, as determined appropriate by the Commissioner.
