This section establishes a new chapter 5 in the Federal Arbitration Act (Title 9, U.S. Code) declaring predispute arbitration agreements and predispute joint-action waivers invalid and unenforceable, at the election of the claimant (or class/collective representative), with respect to age discrimination disputes—involving alleged disparate treatment, disparate impact, harassment, or retaliation against individuals 40 years of age or older—filed under Federal, Tribal, State, or local law. (Thus, courts rather than arbitrators determine the chapter's applicability, validity, and enforceability under Federal law.) The section makes conforming amendments to FAA sections 2, 208, and 307, and to the table of chapters, to reference chapter 5.
