S. 271 — Stop Illegal Reentry Act

This section revises criminal penalties under INA §276 (8 U.S.C. 1326) for illegal reentry by previously removed aliens. It defines "removal" to include any agreement in which an alien stipulates to removal during (or not during) a criminal trial under federal or state law; increases the maximum prison term for general illegal reentry to 5 years (from 2 years); retains maximum 10-year terms for reentry after three or more misdemeanors involving drugs or crimes against the person, a non-aggravated felony, terrorist-related exclusion or removal, or removal under INA §241(a)(4)(B); adds a maximum 10-year term for aliens denied admission, excluded, deported, or removed three or more times; and establishes a mandatory minimum 5-year (and maximum 20-year) prison term for reentry after an aggravated felony conviction or at least two prior illegal reentry convictions (previously up to 20 years maximum for aggravated felons with no minimum). It also updates references from the Attorney General to the Secretary of Homeland Security, revises certain statutory cross-references (e.g., INA §242(h)(2) to §241(a)(4)), and redesignates subsections accordingly.
