S. 2756 — Affordable Inhalers and Nebulizers Act of 2025

This section requires group health plans and health insurance issuers offering group or individual health insurance coverage to cover all specified inhaler products without applying any deductible and with cost-sharing not exceeding $15 per 30-day supply, with such cost-sharing counting toward otherwise applicable deductibles and out-of-pocket maximums. The identical requirements are added as new sections to the Public Health Service Act (§2799A–11), Internal Revenue Code (§9826), and Employee Retirement Income Security Act of 1974 (§726). (Specified inhaler products include maintenance, reliever, or rescue inhalation drugs—such as metered dose inhalers, dry powder inhalers, bronchodilators, and corticosteroids—and related administration equipment—such as nebulizers and spacers—for treating asthma or chronic obstructive pulmonary disease.)
