S. 2767 — Gateway Partnership Act

This section defines key terms for purposes of the Act, including (1) "Foundation" as the Gateway Arch Park Foundation (official philanthropic partner of the Park); (2) "Park" as Gateway Arch National Park; (3) "Park building" as the Arch Visitor Center, the Old Courthouse, and any other building administered or managed by the Secretary as part of the Park that is open to the public; and (4) "Secretary" as the Secretary of the Interior.

This section authorizes the Secretary of the Interior to enter into an agreement with the Foundation to host private events at Gateway Arch National Park, including use of park buildings, subject to terms and conditions that protect park resources and values. Such terms must include (1) exclusive dates and times for Foundation events in specified buildings; (2) a maximum number of events per week and required National Park Service staffing; (3) liability insurance listing the United States as additionally insured; (4) a provision immunizing the federal government from liability for damages, injuries, or deaths arising from the Foundation's use of buildings; and (5) other conditions deemed appropriate by the Secretary. Private events must be consistent with park purposes (i.e., commemorating the Louisiana Purchase and westward expansion), compatible with National Park Service programs, and not degrade park integrity or disrupt public access. The Secretary must charge fees to cover wear-and-tear maintenance costs and, notwithstanding other law, may recover all related costs, including administrative and personnel expenses. This authority does not limit the National Park Service's ability to host its own events or issue permits to others.
