S. 2771 — Indian Programs Advance Appropriations Act of 2025

This section amends the Indian Self-Determination Act and Indian Health Care Improvement Act to authorize, for FY2026 and each fiscal year thereafter, advance appropriations for specified annual accounts of the Bureau of Indian Affairs (BIA), Bureau of Indian Education (BIE), and Indian Health Service (IHS). Such new budget authority provided in annual appropriations acts shall (1) be available for the fiscal year of appropriation and (2) include advance funding available for the subsequent fiscal year. Covered BIA accounts include Operation of Indian Programs, Contract Support Costs (i.e., administrative costs for tribal self-determination contracts), Indian Guaranteed Loan Program, Construction, and Payments for Tribal Leases. Covered BIE accounts include Operation of Indian Education Programs and Education Construction. Covered IHS accounts include Indian Health Services, Contract Support Costs, Payments for Tribal Leases, and Indian Health Facilities. The Secretary of the Interior (for BIA and BIE accounts) and Secretary of Health and Human Services (for IHS accounts) must include detailed estimates of necessary funding for these accounts for the fiscal year following the President's annual budget submission in supporting budget documents pursuant to 31 U.S.C. 1105(a). Not later than July 31 each fiscal year, the relevant Secretary, in consultation with Indian tribes, must submit to Congress a report assessing resource sufficiency for the subsequent fiscal year, including workload and demand estimates.

This section requires the President's annual budget request under 31 U.S.C. 1105(a), as well as specified budget submissions for the Bureau of Indian Affairs (BIA), Bureau of Indian Education (BIE), and Indian Health Service (IHS), to include estimates of appropriations for the fiscal year following the budget year for covered accounts (i.e., accounts funding tribal contract support costs under the Indian Self-Determination Act and Indian Health Care Improvement Act programs). Specifically, the section: (1) adds the requirement to the President's budget for accounts described in ISDA §112(a)(1) and IHCIA §833(a); (2) revises BIA budget requests under ISDA §106(i) (25 U.S.C. 5325(i)) to cover accounts in ISDA §112(a)(1)(A) and directs consultation with Indian Tribes and Tribal organizations; (3) amends BIE provisions in the Education Amendments of 1978 (i) to extend administrative cost grant budget requests under §1128(l)(1) (25 U.S.C. 2008(l)(1)) to the following fiscal year; (ii) to extend Division of Budget Analysis reports under §1129(c) (25 U.S.C. 2009(c)) to the following fiscal year; and (iii) to add the requirement to annual budget requests under §1135(b) (25 U.S.C. 2015(b)) for accounts in ISDA §112(a)(1)(B); and (4) restructures IHS budget requirements under IHCIA §826 (25 U.S.C. 1680p) to retain amounts reflecting changes in the cost of health services (previously "health care services"), as indexed to the Consumer Price Index, and population served by the IHS, while adding estimates for the following fiscal year for accounts in IHCIA §833(a).
