S. 2774 — Stop Greenlighting Driver Licenses for Illegal Immigrants Act of 2025

This section defines three terms for purposes of the Act: (1) "Edward Byrne Memorial Justice Assistance Grant Program funds," meaning grants under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (34 U.S.C. 10151 et seq.), including direct grants to units of local government under 34 U.S.C. 10156(d); (2) "immigration enforcement information," meaning information relating to an individual's citizenship or immigration status or the date, time, and location of any individual's release from detention, jail, or prison; and (3) "State," as defined in 34 U.S.C. 10251.

This section establishes restrictions on Edward Byrne Memorial Justice Assistance Grant Program (Byrne JAG) funding—formula grants to states and localities for law enforcement, prosecution, courts, corrections, and crime prevention—for states that (1) issue driver's licenses to individuals lacking proof of U.S. citizenship or lawful presence or (2) prohibit or restrict state or local entities from sharing immigration enforcement information with the Department of Homeland Security (DHS). Penalties include (1) for driver's license violations, returning any unobligated Byrne JAG funds to the Treasury within 30 days of issuance; (2) for information-sharing restrictions, returning any unobligated Byrne JAG funds within 30 days of enactment; and (3) ineligibility for future Byrne JAG funds until the state enacts a law or policy prohibiting such driver's licenses and permitting information sharing with DHS. (Thus, noncompliance triggers immediate repayment of unobligated funds and bars new awards pending policy changes.)
