S. 2798 — Equal Employment for All Act of 2025

This section amends section 604 of the Fair Credit Reporting Act to generally prohibit persons, including employers, from using or procuring a consumer report or investigative consumer report containing information on a consumer's creditworthiness, credit standing, or credit capacity for employment purposes or adverse actions (as described in FCRA section 603(k)(1)(B)(ii)), even if the consumer consents. Exceptions apply for employment requiring national security clearance or where otherwise required by law; disclosure, authorization, and notification requirements under the FCRA otherwise remain applicable. (Thus, consumer reporting agencies may not furnish such reports to employers seeking to use credit information for employment denials or decisions, absent an exception.) The section further restricts consumer reporting agencies from furnishing such credit-bearing reports for employment purposes (with the same exceptions); prohibits denying employment solely for a consumer's refusal to authorize procurement of such a report; and makes conforming amendments to FCRA sections 603, 604, 607, 609, and 613 to update cross-references due to subsection redesignations.
