S. 2800 — Pharmacy and Medically Underserved Areas Enhancement Act

This section establishes Medicare Part B coverage for pharmacist services (as defined in new SSA §1861(s)(2)(KK)) furnished by a state-licensed pharmacist, individually or on behalf of a pharmacy provider, if legally authorized by state law, otherwise covered if furnished by a physician or incident to a physician service, and provided in a health professional shortage area (as defined in PHS Act §332(a)(1)(A)), medically underserved area, or medically underserved population (as defined in PHS Act §330(b)(3)). It provides for payment equal to 80 percent of the lesser of the actual charge or 85 percent of the physician fee schedule amount under SSA §1848 (as if furnished by a physician). The amendments apply to services furnished on or after January 1, 2027, and directs the Secretary of Health and Human Services to develop necessary pharmacist-specific codes under the physician fee schedule.
