S. 2804 — Strengthen Wood Products Supply Chain Act of 2025

This section defines terms used in the Act: (1) importer, as any person seeking to import plants (as defined under the Lacey Act); (2) Lacey Act, as the Lacey Act Amendments of 1981 (16 U.S.C. 3371 et seq.); (3) plant, as defined under the Lacey Act; and (4) Secretary, as the Secretary of the Interior acting through the Director of the United States Fish and Wildlife Service.

This section establishes procedures and timelines for the detention of plants by the Secretary of Agriculture upon presentation by U.S. Customs and Border Protection (CBP) for physical examination on suspicion of a Lacey Act violation (i.e., prohibition on importing plants taken, possessed, transported, or sold in violation of U.S., state, tribal, or foreign law). Within 5 days (excluding weekends and federal holidays) of presentation, the Secretary must release the plants or issue a notice of detention specifying reasons, anticipated length, tests to be conducted, information to accelerate resolution, and option for bonded transport to another location; test results, replication details, and documentation must be provided to the importer. Not later than 10 days after a detention notice, the Secretary must allow transport outside CBP custody for storage if the importer requests, pays fees, posts bond, complies with 19 C.F.R. §§ 151.7-151.11 (or successor regulations), and the move does not frustrate the Lacey Act; not later than 30 days after presentation, the Secretary must issue a final admissibility determination (failure treated as exclusion with demand for redelivery), after which importers may protest (with Secretary decision due in 30 days) or seek court review under 50 C.F.R. part 12 (or successor regulations). The Secretary must promulgate implementing regulations within 180 days of enactment. (Thus, these requirements prevent indefinite holds, facilitate importer access to evidence and movement options, and provide expedited resolution and appeal rights.)
