S. 2805 — Designating the Russian Federation as a State Sponsor of Terrorism Act

This section makes findings on the Russian Federation's aggression in Ukraine since February 2022, including that at least 648 Ukrainian children have been killed, 2,047 wounded, and 19,546 kidnapped, deported, or displaced to Russia or Russian-occupied territories, with many subjected to re-education camps, paramilitary training, and curricula intended to erase Ukrainian identity and promote allegiance to Russia.

This section requires the Secretary of State to submit a report to Congress within 60 days of enactment certifying whether Ukrainian children kidnapped, deported, or forcibly removed from Ukraine since the Russian invasion in February 2022 have been reunited with their families or guardians in a secure environment and whether their full reintegration into Ukrainian society is underway. If the Secretary cannot make both certifications, the section requires the immediate designation of the Russian Federation as a state sponsor of terrorism under section 1754(c) of the National Defense Authorization Act for Fiscal Year 2019, section 40 of the Arms Export Control Act, section 620A of the Foreign Assistance Act of 1961, and other relevant laws.

This section authorizes the Secretary of State to rescind the designation of the Russian Federation as a state sponsor of terrorism on or after the date that is 45 days after the Secretary certifies to Congress that the Russian government has not provided support for international terrorism during the preceding 3-month period and has provided assurances that it will not support such acts in the future; that all children kidnapped, deported, or forcibly transferred from Ukrainian territory or temporarily occupied Ukrainian territory since the Russian Federation’s invasion of Ukraine in February 2022 have been reunited with their families and guardians in a secure environment; and that the process of full reintegration of such children into Ukrainian society is underway.
