S. 2806 — Eliminate Shutdowns Act

This section establishes automatic continuing appropriations for federal programs, projects, and activities during a lapse in appropriations. It defines a lapse as a period when no full-year or continuing appropriation Act is in effect for a program that received funding in the preceding applicable appropriation Act. Appropriations are provided at the rate for operations under the authorities and conditions in the preceding Act, available for successive 14-calendar-day periods until an appropriation or continuing resolution is enacted; entitlements, mandatory payments, and activities under the Food and Nutrition Act of 2008 are funded at the rate necessary to maintain current-law program levels. The section limits initial high rates of operation or grant awards for programs with front-loaded distributions, caps inter-account transfers at 5 percent of any appropriation account, and requires the most limited funding action necessary to continue operations.

This section classifies the budgetary effects of the Act and amendments made by the Act as if they were discretionary appropriation Acts for purposes of section 251 of the Balanced Budget and Emergency Deficit Control Act of 1985. It treats the provision of budgetary resources under section 1311 of title 31, United States Code, as added by the Act, as a continuing appropriation in effect for less than the entire current year when calculating the baseline under section 257 of that Act. For enforcement of discretionary spending limits under section 251(a), the section deems such resources to be part-year appropriations and delays the due date of any required report under section 254(f) during a lapse in appropriations to the later of the date specified in section 251(a)(1) or 30 calendar days after the first day of the lapse.
