S. 2813 — FIRE Act

This section amends the Gun Control Act of 1968 to (1) prohibit any federal officer or employee from prescribing or enforcing a regulation that imposes a limitation or prohibition on a firearm magazine based on its capacity; (2) declare that any state or local law imposing a limitation, prohibition, or penalty on a firearm magazine based on its capacity has no force or effect; and (3) define "firearm magazine" as a fixed or detachable device for storing and feeding ammunition into a firearm, with "capacity" meaning the number of rounds of ammunition it can store. The amendments apply to conduct engaged in on or after the date that is 30 days after enactment.
