This section establishes in the Treasury the Community Economic Development Transmission Fund, consisting of portions of interest charged and collected each fiscal year on covered loans—defined as certain Department of Energy loans issued after enactment for electric power transmission lines capable of transmitting 999 megawatts or more (including under section 40106 of the Infrastructure Investment and Jobs Act and the Western Area Power Administration's Transmission Infrastructure Program)—with the portion determined by the Secretary of Energy in consultation with the Secretary of the Treasury. Amounts in the Fund are available, as provided in appropriation Acts, for payments by the Secretary to host communities—local governments (e.g., municipalities, towns, counties) or Indian tribes (as defined in 25 U.S.C. 5304) with jurisdiction over eligible project lands—not later than 18 months after construction of the project commences, with one payment per project per host community upon request within one year of notice provided during federal siting and permitting processes and certification of eligible use. Payment amounts are determined by a formula, developed with stakeholder input, that ensures long-term Fund solvency and includes a small-population community minimum; such payments are in addition to any payments in lieu of taxes under 31 U.S.C. chapter 69 and may be used with up to 80% for community support services, projects, or programs (e.g., infrastructure improvements or essential public services such as public schools, libraries, hospitals, roads, broadband access at community anchor institutions, agricultural support, and workforce training).
