S. 2857 — Protecting Free Vaccines Act of 2025

This section requires group health plans and health insurance issuers offering group or individual coverage to cover without cost sharing, for plan years occurring on the date of enactment or beginning on or after such date before January 1, 2030, immunizations recommended by the Advisory Committee on Immunization Practices (ACIP) of the Centers for Disease Control and Prevention (CDC) as of October 25, 2024—including vaccines updated via approved supplemental biologics license applications before that date—subject to an exception for immunizations administered during the minimum interval under PHSA section 2713(b). It implements this requirement by adding parallel provisions to part D of PHSA title XXVII (42 U.S.C. 300gg–111 et seq.), ERISA subpart B of part 7 of subtitle B of title I (29 U.S.C. 1185 et seq.), and IRC subchapter B of chapter 100, with conforming and clerical amendments. This section further amends Medicare Part D regulations under SSA section 1860D–2(b)(8)(B) (42 U.S.C. 1395w–102(b)(8)(B)) to require coverage without cost sharing, for the same plan years, of vaccines whose ACIP recommendation is revoked on or after October 25, 2024, based on the most recent prior recommendation for the individual (including prior updates). (Thus, the changes lock in no-cost coverage for approximately 20 ACIP-recommended vaccines as of that date, such as those for COVID-19, influenza, HPV, and RSV, against subsequent revocations during the period.) This section also amends Medicaid coverage requirements under SSA section 1905(a)(13)(B) (42 U.S.C. 1396d).
