S. 286 — Stop Human Trafficking of Unaccompanied Migrant Children Act of 2025

This section establishes vetting standards for sponsors of unaccompanied alien children (UACs) in the custody of the Director of the Office of Refugee Resettlement (ORR) in the Department of Health and Human Services (HHS). (As background, ORR is responsible for the care, placement, and release of UACs in federal custody by reason of their immigration status, typically to suitable family sponsors after transfer from Department of Homeland Security custody.) Specifically, the section requires (1) fingerprint-based background checks—including public records, National Sex Offender Registry, FBI criminal history, State child abuse/neglect checks, and State/local criminal records—for prospective sponsors and all adults 18 years or older in the sponsor's household, to the satisfaction of the HHS Secretary, relevant State child services agency, and in consultation with the Attorney General and DHS Secretary, prior to any UAC release; (2) a prohibition on releasing UACs to sponsors who are unlawfully present in the United States, unless the sponsor is the child's biological parent, legal guardian, or relative; (3) a mandatory pre-release home visit to the proposed placement household and specified post-release unannounced in-person home visits (not fewer than 5 during the first year after release and 1 each quarter during the second year, for UACs released after enactment); and (4) immediate retroactive vetting using the same process for all sponsors of UACs released since January 20, 2021. The section further requires joint monthly HHS-DHS reports to specified congressional committees on UAC encounters, transfers to ORR custody, sponsor vetting and home visits completed or in progress, UAC releases by sponsor category, ORR custody numbers by State and facility, and sponsor application rejection rates; and separate joint monthly reports to Congress on efforts to locate UACs released to sponsors since January 20, 2021, who are reported missing or have no post-release record as of enactment.
