§2.Regulation of certain machines
This section revises the definitions in the Controlled Substances Act (CSA) by (1) expanding "regulated person" to include any person who manufactures, distributes, delivers, sells, imports, exports, or acts as a broker/trader for an international transaction involving a tableting machine, encapsulating machine, or critical part (i.e., upper punch, lower punch, or die); (2) expanding "regulated transaction" to include any distribution, delivery, sale, importation, or exportation of such machines or parts; and (3) adding definitions for "critical part," "die," "lower punch," "punch," and "upper punch."
This section further requires regulated persons to identify tableting machines, encapsulating machines, and critical parts with serial numbers affixed to nonremovable parts, as prescribed by Attorney General regulations to be issued within 180 days of enactment (with guidance for pre-enactment machines); mandates monthly reports to the Attorney General of regulated transactions in such items, including serial numbers; and makes these requirements effective only after the regulations' effective date. (Thus, the changes enable tracking of machines/parts commonly used to produce illicit controlled substances.)
This section adds as CSA prohibited acts (1) removing, altering, or obliterating a required serial number on such machines/parts with reasonable cause to believe it is required; and (2) transporting, shipping, receiving, possessing, distributing, delivering, selling, importing, or exporting such items knowing the serial number has been removed/altered/obliterated with reasonable cause to believe it is required.
