S. 2882 — Continuing Appropriations and Extensions and Other Matters Act, 2026

This section appropriates funds for fiscal year 2026—and other purposes—to departments, agencies, corporations, and other organizational units of the federal government from any money in the Treasury not otherwise appropriated and from applicable corporate or other revenues, receipts, and funds.

This section provides appropriations at fiscal year 2025 rates for operations, under the same authority and conditions, for projects and activities (including direct loan and loan guarantee costs) conducted in FY2025 under the Full-Year Continuing Appropriations Act, 2025 (division A of P.L. 119-4)—excluding sections 1110, 1113, and 1114 and the proviso in section 1602(4)—that are not otherwise specifically provided for in this Act.

This section prohibits the Department of Defense from using funds made available by this Act (1) for new production of items not funded for production in FY2025 or prior fiscal years; (2) to increase production rates above those sustained with FY2025 funds; or (3) to initiate, resume, or continue any project, activity, operation, or organization—which includes any project, subproject, activity, budget activity, program element, subprogram within a program element, P–1 line item in a budget activity within an appropriation account, or R–1 line item that includes a program element and subprogram element within an appropriation account—for which funds or authority were not available in FY2025. The section further prohibits such funds from initiating multi-year procurements utilizing advance procurement funding for economic order quantity procurement unless specifically appropriated later.

This section prohibits the use of appropriations or funds made available under section 101 to initiate or resume any project or activity for which appropriations, funds, or authority were not available during FY2025, except as otherwise provided in section 102.

This section provides that appropriations made and authority granted pursuant to this Act cover all obligations or expenditures incurred for any project or activity during the period for which funds or authority for such project or activity are available under this Act.

This section makes appropriations, funds, and authorities provided by this Act available until the earliest of (1) enactment of a specific appropriation for the project or activity, (2) enactment of the applicable FY2026 appropriations Act without provision for such project or activity, or (3) October 31, 2025.

This section specifies that expenditures made pursuant to this Act shall be charged to the applicable appropriation, fund, or authorization upon enactment of the bill containing it into law.

This section waives the deadlines for submission of apportionment information (40 days before the fiscal year or 15 days after enactment), presidential notification of apportionments (20 days before the fiscal year or 30 days after enactment), and issuance of apportionments (30 days before or after enactment) under 31 U.S.C. 1513(a)-(b) for appropriations made available by this Act. (Thus, relevant agencies may obligate such funds without adhering to those timelines, subject to other apportionment requirements.)

This section prohibits high initial rates of operation or complete distribution of appropriations at the beginning of FY2026 for programs funded by this Act that distribute funds to states, foreign countries, grantees, or others (notwithstanding other provisions of the Act except sec. 106). It further prohibits awarding grants under such programs if doing so would impinge on final funding prerogatives.

This section prohibits the use of funds appropriated by this or any other appropriations Act to increase, eliminate, or reduce funding for a program, project, or activity as proposed in the President's budget request for a fiscal year until such proposed change is enacted in an appropriations Act, notwithstanding section 101.

This section continues, through the date specified in section 106(3), (1) entitlements and other mandatory payments whose budget authority was provided in appropriations acts listed in section 101, (2) expenses authorized under the Cost of War Toxic Exposures Fund (38 U.S.C. 324)—which funds Department of Veterans Affairs health care, benefits administration, and research for veterans exposed to environmental hazards—at rates necessary to maintain program levels under current law, and (3) activities under the Food and Nutrition Act of 2008. The section further permits obligations for such mandatory payments due on or about the first day of any month beginning after October 2025 but not later than 30 days after the date specified in section 106(3).

This section authorizes departments and agencies to apportion amounts available under section 101 for civilian personnel compensation and benefits up to the rate for operations necessary to avoid furloughs, consistent with the applicable FY2025 appropriations Act, provided that such authority is not used until after taking all necessary actions to reduce or defer non-personnel-related administrative expenses.

This section provides that funds appropriated by this Act may be obligated and expended notwithstanding (1) 22 U.S.C. 2412 (which prohibits obligating foreign assistance funds without prior congressional authorization or in excess of authorized amounts), (2) 22 U.S.C. 2680, (3) 22 U.S.C. 6212, and (4) 50 U.S.C. 3094(a)(1).

This section rescinds prior congressional designations of emergency requirements under section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 (BBEDCA) for amounts incorporated by reference in this Act—including those in specified sections of P.L. 119-4, P.L. 118-42, and P.L. 118-47—and redesignates them as emergency requirements under section 4001(a)(1) of S. Con. Res. 14 (117th Congress, the FY2022 budget resolution) and FY2026 House budget enforcement legislation. (Thus, these amounts remain exempt from certain spending limits.) It further (1) redesignates prior disaster relief designations under BBEDCA section 251(b)(2)(D) pursuant to a concurrent budget resolution; and (2) continues prior emergency designations from specified divisions of P.L. 117-159, P.L. 117-58, and P.L. 117-328 as specified in section 103(b) of division A of P.L. 118-5. The section is effective immediately upon enactment and remains in effect through the date specified in section 106(3).

This section ratifies congressional emergency designations made pursuant to section 1110(a) of division A of Public Law 119-4 (i.e., amounts exempt from sequestration under section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985) as if designated by the President under section 1110(b) of that law, including any repurposing, rescission, or transfer of such amounts and ratification of related anticipatory obligations. It further (1) amends section 251(b)(2)(A) of that Act by striking the requirement that "the President subsequently so designates" congressional emergency requirements each place it appears (thus, allowing future congressional designations alone to exempt such spending from sequestration); (2) applies the budgetary effects waiver in section 103(a) of division A of Public Law 118-5 to this section; and (3) takes effect upon enactment (or, if after September 30, 2025, as if in effect on that date).

This section authorizes the continuation of specified rescissions or cancellations of discretionary budget authority under section 101 in certain Treasury Appropriations Fund Symbols (TAFS)—(1) those without other appropriations in this Act but with a current applicable TAFS receiving an appropriation in this Act, or (2) no-year TAFS receiving other appropriations in this Act—by reducing the rate for operations otherwise provided by section 101 for such current applicable TAFS, provided it does not impinge on congressional funding prerogatives. The amount continued equals the lesser of (1) the amount specified for rescission or cancellation in the applicable prior appropriations Act or (2) balances available as of October 1, 2025, from the specified funds. This section further directs the Office of Management and Budget to provide Appropriations Committees of the House and Senate a comprehensive list of such rescissions or cancellations by October 31, 2025, with periodic updates reflecting changes in available balances as of October 1, 2025, transmitted upon request.

This section extends the availability until September 30, 2026 (from September 30, 2025), of remaining unobligated balances from prior appropriations—including those proposed for rescission in the President’s special message EC-1680 (September 8, 2025)—that (1) were subject to apportionment under 31 U.S.C. §1513(b), (2) were not made available for immediate obligation without precondition at least 90 days prior to expiration and continuously thereafter, and (3) were not available for obligation after September 30, 2025, prior to enactment. (Thus, such balances remain available for their original purposes under the same authorities and conditions and are exempt from further apportionment.) The section further (1) directs the Office of Management and Budget to submit a comprehensive list of extended amounts to the House and Senate Appropriations Committees by November 17, 2025; (2) requires the Comptroller General to audit compliance by January 15, 2026, and conduct subsequent audits as appropriate, reporting findings to the Committees; and (3) applies retroactively to September 30, 2025, if enacted after that date, with budgetary effects subject to section 103(a) of division A of Public Law 118-5.

This section, for this fiscal year and thereafter, (1) nullifies subsection (d) of section 1017 of the Congressional Budget and Impoundment Control Act of 1974; (2) requires budget authority proposed to be rescinded or deferred (or reserved) in a special message under section 1012 or 1013 of such Act to be made available for obligation in sufficient time as required under those sections and prohibits its deferral or withholding during the 90-day period before the expiration of its period of availability; (3) requires apportionments of an appropriation (as defined in 31 U.S.C. §1511 to include appropriated amounts, funds, and contract authority) under 31 U.S.C. §1513(b) to make all amounts available for obligation in sufficient time to be prudently obligated and to make all amounts available for immediate obligation without precondition (including by footnote) not later than 90 days before the expiration of the period of availability, remaining continuously available during that period; and (4) defines budget authority to include authority made available by this or any other Act, prior or subsequent appropriations Acts, or any law other than an appropriations Act.

This section provides $8.2 billion for operations of the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC)—notwithstanding section 101. (WIC provides supplemental foods, nutrition education, and health care referrals to low-income pregnant, breastfeeding, and postpartum women and to infants and children up to age five determined to be at nutritional risk.)

This section extends the Livestock Mandatory Reporting program through the date specified in section 106(3) of this Act (from September 30, 2025). The program requires packers of cattle, swine, and lambs to report to USDA on prices, purchase contracts, and supply-and-demand conditions to promote market transparency for producers and other participants.

This section makes expired but uncancelled amounts in the Exploration, Space Operations, Human Space Flight, Space Flight Capabilities, and Exploration Capabilities appropriations accounts available through FY2030 (previously expired) for liquidating valid obligations incurred in FY2001 through FY2013 for Space Shuttle contracts and associated programs closeout. The section is effective immediately upon enactment or, if enacted after September 30, 2025, applies retroactively as of that date.

This section requires the National Aeronautics and Space Administration (NASA) Science Mission Directorate to continue any missions in operation (including extended operations), development, or formulation as of September 1, 2025, during the period covered by this Act.

This section directs the National Science Foundation to apportion amounts made available under section 101 for Research and Related Activities, Major Research Equipment and Facilities Construction, STEM Education, and Agency Operations and Award Management at a rate necessary to maintain research facilities and scientific awards at the current level.

This section directs that amounts made available by section 101 for National Oceanic and Atmospheric Administration (NOAA) operations, research, and facilities be apportioned at a rate necessary to maintain the Office of Oceanic and Atmospheric Research at its current level, including for research laboratories, cooperative institutes, and scientific awards.

This section directs the Secretary of Commerce, during the period covered by this Act, to renew all cooperative agreements under the Hollings Manufacturing Extension Partnership for eligible entities (i.e., U.S.-based nonprofits, institutions of higher education, or state, territorial, local, or tribal governments or consortia thereof) in each state and Puerto Rico under the same terms and conditions as the previous agreements, unless requested otherwise by the eligible entity. (The Partnership supports a nationwide network of manufacturing extension centers that deliver training, technical assistance, and other services to small and medium-sized manufacturers.)

This section authorizes apportionment up to the rate for operations of amounts made available by section 101 for Department of Justice—United States Marshals Service—Salaries and Expenses to maintain program operations.

This section appropriates $30 million for FY2026 for Department of Justice—United States Marshals Service—Salaries and Expenses, to remain available until September 30, 2027, in addition to amounts otherwise provided by section 101, of which $7 million is for protective operations and $23 million is to enhance the federal judicial security mission. It requires the United States Marshals Service to submit quarterly reports, beginning 30 days after enactment, to the House and Senate Appropriations Committees detailing its protective details, associated costs, and supporting threat assessments or other information.

This section provides $30 million for FY2026, in addition to amounts otherwise available, for the Department of Justice—United States Marshals Service—Construction account to support critical courthouse security renovations and upgrades in spaces controlled, occupied, or utilized by the United States Marshals Service and to secure prisoner movement areas. The funds remain available until expended and are designated by Congress as an emergency requirement pursuant to section 4001(a)(1) of S. Con. Res. 14 (117th Congress) and legislation establishing FY2026 budget enforcement in the House of Representatives.

This section temporarily modifies section 235(b) of the Sentencing Reform Act of 1984 (as a note to 18 U.S.C. 3551), as such section relates to chapter 311 of title 18, United States Code (probation), and the United States Parole Commission, by substituting "38" for "37" each place it appears during the period covered by this Act. (Thus, this extends the Commission's authority to supervise certain pre-Guidelines federal and D.C. offenders by one year.)

This section permits apportionment of up to $154 million from amounts provided by section 101 of this Act to the Department of Defense for Shipbuilding and Conversion, Navy— notwithstanding sections 102 and 104—for operations necessary to complete prior-year shipbuilding programs for the FY2016 and FY2018 Virginia-class submarines.

This section provides up to $399.7 million for continued rapid prototyping activities, to maintain schedule and transition to production, for the E–7 Wedgetail aircraft program (i.e., Air Force acquisition of Boeing E–7A for airborne early warning and control) by (1) directing apportionment of up to $199,676,000 from Research, Development, Test, and Evaluation, Air Force, amounts available under section 101, notwithstanding sections 102 and 104; and (2) transferring $200 million from unobligated balances available under Aircraft Procurement, Air Force, in P.L. 119–4, to such RDT&E amounts. The section further requires the Secretary of the Air Force to obligate such funds without reserving the full estimated cancellation liability and prohibits the use of any appropriated funds, including from prior acts, to pause, cancel, terminate, or prepare to pause, cancel, or terminate the program.

This section increases the amount specified in the first proviso under the heading “Department of Energy—Atomic Energy Defense Activities—National Nuclear Security Administration—Weapons Activities” in division D of Public Law 118–42 to $149,244,000 (from $118,056,000), notwithstanding section 101.

This section temporarily extends dates in title I of the CALFED Bay-Delta Authorization Act (P.L. 108-361) to 2026 (from 2022) each place "2022" appears and increases an authorization of appropriations in section 103(f)(4)(A) to $32,600,000 (from $30,000,000). (As background, title I authorizes federal participation in the CALFED Bay-Delta Program, a federal-state initiative to improve water supply reliability, water quality, and ecosystem restoration in California's Sacramento-San Joaquin Delta.)

This section directs the Department of Energy to obligate and expend amounts appropriated for Energy Efficiency and Renewable Energy, Electricity, Fossil Energy and Carbon Management, and Cybersecurity, Energy Security, and Emergency Response in the programs, projects, and activities—and in the amounts—specified in the "Final Bill" column of the Department of Energy table under the heading "Title III—Department of Energy" in the explanatory statement described in section 4 preceding division A of P.L. 118-42 (notwithstanding section 101). The section further provides that subsections (e), (f), and (g) of section 301 of P.L. 118-42 do not apply to such amounts.

This section requires the Secretary of Energy to complete hot commissioning of the Direct-Feed Low Activity Waste facility at the Hanford Site in Richland, Washington, by October 15, 2025—unless the Washington Department of Ecology agrees to a different date—and thereafter to operate the facility at an average melter throughput rate of radioactive tank waste consistent with milestone A-22 in the Washington v. Wright consent decree. (As background, the facility is part of the Hanford tank waste treatment program, which vitrifies approximately 90% of the site's low-activity waste from 177 underground tanks holding 56 million gallons of radioactive waste pursuant to a 2010 court-ordered cleanup agreement.)

This section authorizes apportionment of amounts made available by section 101 for the Small Business Administration Business Loans Program Account up to the rate for operations necessary to accommodate increased demand for (1) commitments for general business loans under paragraphs (1) through (35) of section 7(a) of the Small Business Act (15 U.S.C. 636(a)); (2) commitments to guarantee trust certificates under section 5(g) of the Small Business Act (15 U.S.C. 634(g)); (3) commitments to guarantee loans under section 503 of the Small Business Investment Act of 1958 (15 U.S.C. 697); and (4) commitments to guarantee debentures under section 303(b) of the Small Business Investment Act of 1958 (15 U.S.C. 683(b)).

This section permits the District of Columbia to expend local funds made available under the “District of Columbia—District of Columbia Funds” heading for programs and activities under the District of Columbia Appropriations Act, 2024 (title IV of division B of Public Law 118–47), at the rate set forth in the Fiscal Year 2026 Local Budget Act of 2025 (D.C. Bill 26–260), as modified as of enactment. (Thus, this provision overrides other restrictions in the act except section 106.)

This section provides $1,534,910,000 for Defender Services (i.e., payments under the Criminal Justice Act for counsel, investigative, expert, and other services necessary to represent indigent persons financially unable to obtain adequate representation in federal felony and certain misdemeanor cases, juvenile delinquency proceedings, supervised release matters, and other specified proceedings) at a rate for operations, notwithstanding section 101, and authorizes apportionment up to that rate as necessary to make such payments.

This section revises funding under the Office of Personnel Management (OPM)—Salaries and Expenses heading in title V of division B of Public Law 118-47, notwithstanding section 101, by (1) reducing the amount preceding the first proviso to $197,446,000 (from $219,076,000); and (2) increasing the amount in the second proviso to $214,605,000 (from $192,975,000).

This section modifies the application of section 1605 of title VI of division A of Public Law 119–4 by extending it through the end of the last applicable pay period commencing in calendar year 2025 and, beginning the first applicable pay period on or after January 1, 2026, applying it through the date specified in section 106(3) of this Act as follows: (1) substituting the section 106(3) date for “the date specified in section 1106 of this Act”; (2) not applying paragraph (1); (3) substituting “2026” for “2025” in paragraph (2); (4) substituting “2027” for “2026” in paragraph (3); and (5) not applying paragraph (4).

This section establishes an Office of Inspector General (OIG) for the Office of Management and Budget (OMB), notwithstanding section 106. (1) It requires the President to appoint an Inspector General within 45 days of enactment, in accordance with 5 U.S.C. §403(a); grants the OIG jurisdiction over matters assigned to OMB under law or delegated to OMB; and applies chapter 4 of title 5, U.S. Code (i.e., the Inspector General Act of 1978, as amended), to the OIG. (2) It appropriates $20 million for FY2026 for necessary expenses of the OIG, available until September 30, 2027; exempts such funds and all future appropriations to the OIG from apportionment under subchapter II of chapter 15 of title 31, U.S. Code; and subjects the funds to the authorities and conditions of title II of division B of Public Law 118-47.

This section provides $28 million, to remain available until expended, to the Supreme Court of the United States—Salaries and Expenses account within the Judiciary appropriation for protection of the residences of the Supreme Court Justices.

This section provides $52 million, to remain available until expended, for security improvements at United States courthouses and federal court facilities within the Court Security account under Judiciary—Court of Appeals, District Courts, and Other Judicial Services.

This section authorizes apportionment up to the rate for operations necessary to carry out response and recovery activities under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (i.e., Stafford Act) of amounts made available by section 101 to the Department of Homeland Security under the heading “Federal Emergency Management Agency—Disaster Relief Fund.” (Thus, providing spending flexibility for the Disaster Relief Fund, FEMA's primary account for reimbursing state, local, tribal, and territorial governments—and certain nonprofits—for eligible disaster costs.)

This section extends the Department of Energy's authority to waive competitive bidding requirements for contracts for the maintenance and operation of the Strategic Petroleum Reserve through calendar years 2021 through 2026 (from 2021 through 2024), during the period covered by this Act. (The Strategic Petroleum Reserve is the U.S. emergency crude oil stockpile.)

This section authorizes apportionment up to the rate for operations of amounts made available by section 101 for Department of Agriculture—Forest Service—Wildland Fire Management for wildfire suppression activities.

This section provides additional funding, in addition to amounts otherwise provided by section 101, for the Indian Health Service (IHS), which delivers medical and public health services to American Indians and Alaska Natives. Specifically, the section provides (1) $72,265,000 at a rate for operations for the IHS Indian Health Services account for staffing and operating facilities opened, renovated, or expanded in FY2025 and FY2026; and (2) $8,050,000 at a rate for operations for the IHS Indian Health Facilities account for the same purpose. Such amounts may be apportioned up to the rate for operations necessary to staff and operate such facilities.

This section expands the applicability of the 19th unnumbered paragraph under the heading "Administrative Provisions, Forest Service" in title III of PL 109-54 (as amended) by striking phrases limiting it to funds appropriated in that Act and the period prior to its enactment.

This section appropriates $490,960,000 for fiscal year 2026 to the Corporation for Public Broadcasting (CPB)—in addition to amounts otherwise provided—to remain available until September 30, 2026, with payment required not later than three days after enactment. (As background, CPB provides grants to more than 1,400 public television and radio stations for programming and operations.) Such funds are available under the terms of the FY2024 appropriations act for CPB, except the allocation formula in section 396(k)(3) of the Communications Act of 1934 (47 U.S.C. 396(k)(3)) applies as if $535 million were available and no funds are provided under subclauses (II) and (III) of subparagraph (A)(iii).

This section sets the base grant at $8 million for each of the Federated States of Micronesia and the Republic of the Marshall Islands under sec. 640(a)(2)(B)(v) of the Head Start Act for purposes of allotting funds under the Children and Families Services Programs appropriation, deeming such amount equal to the prior fiscal year's base grant. (The Head Start program provides early childhood education, health, nutrition, and parent involvement services to low-income children and their families.)

This section prohibits cost-of-living adjustments to the pay of Members of Congress, congressional leaders, and the Speaker of the House under 2 U.S.C. 4501 during the period covered by this Act.

This section appropriates additional amounts for FY2026 for congressional security, as follows: (1) $90 million for House of Representatives salaries and expenses of the Office of the Sergeant at Arms for enhanced Member security programs, to remain available until expended; (2) $66.5 million for Senate contingent expenses of the Sergeant at Arms and Doorkeeper, of which $53 million is for the Business Continuity and Disaster Recovery Fund for enhanced Member security (to remain available until expended), $3.5 million is for the residential security system program (to remain available through September 30, 2030), and $10 million is for state office security activities (to remain available through September 30, 2030); and (3) $30 million for Capitol Police mutual aid reimbursements (to remain available until expended). The section requires notification to specified committees within 15 days of obligation and designates the amounts as an emergency requirement pursuant to specified budget resolutions.

This section provides additional funding of $6,865,235 for the cost of direct loans under the Native American Veteran Housing Loan Program (i.e., VA direct loans to eligible Native American veterans to purchase, construct, or improve a home on trust land or restricted land). Such funds subsidize gross obligations for the principal amount of direct loans not to exceed $75,000,000.

This section authorizes the U.S. Governor of the European Bank for Reconstruction and Development (EBRD)—a multilateral development bank that finances private-sector-led projects in Europe, Central Asia, and North Africa—to subscribe on behalf of the United States to up to 40,000 additional shares of the Bank's paid-in capital stock, effective only to the extent provided in advance in appropriations Acts. The section further authorizes appropriations of $437,457,804, without fiscal year limitation, for the Secretary of the Treasury to pay for such subscription.

This section authorizes apportionment of amounts made available by section 101 for Department of Transportation—Office of the Secretary—Payments to Air Carriers up to the rate necessary to maintain Essential Air Service (EAS) program operations. (EAS subsidizes scheduled passenger air service to small, rural communities that are otherwise isolated from the national air transportation system.)

This section permanently rescinds, as of September 30, 2025, any remaining unobligated balances from FY2022 appropriations under division L of P.L. 117-103 for competitive awards eligible under the PROTECT program's planning grants (23 U.S.C. 176(d)(4)(A)) and resilience improvement grants (23 U.S.C. 176(d)(4)(C))—which fund transportation vulnerability assessments and projects to withstand weather events and natural disasters—and appropriates an equivalent amount as additional FY2025 budget authority, available through September 30, 2026, solely to complete funding those same FY2022 awards without further competition. The rescission and reappropriation are effective immediately upon enactment (or retroactively as of September 30, 2025, if enacted later).

This section authorizes the use of FY2026 funds appropriated under the Department of Housing and Urban Development—Public and Indian Housing—Tenant-Based Rental Assistance account (i.e., Housing Choice Voucher program) for additional allocations under specified subparagraphs to prevent the termination of rental assistance for families due to insufficient funding in the calendar year 2025 funding cycle. The Secretary of Housing and Urban Development must notify the House and Senate Committees on Appropriations at least three business days before allotting such funds.

This section requires the Secretary of Housing and Urban Development, by December 15, 2025, to noncompetitively renew for one 12-month period all existing Continuum of Care grants and youth homelessness demonstration projects expiring in calendar year 2026, notwithstanding conflicting provisions in subtitle C of title IV of the McKinney-Vento Homeless Assistance Act. Renewal amounts must incorporate reasonable cost-of-living adjustments for supportive services and fiscal year 2025 fair market rents.

This section rescinds all remaining unobligated balances as of September 30, 2025, from FY2024 appropriations to the Department of Housing and Urban Development—Fair Housing and Equal Opportunity—Fair Housing Activities account (Public Law 118-42, div. F, title II) and reappropriates an equivalent amount as new FY2025 budget authority, available through September 30, 2026, to complete awards under the FY2024 Fair Housing Initiatives Program (FHIP). (FHIP, under 42 U.S.C. 3616a, funds grants and contracts for state and local governments and nonprofits to enforce Fair Housing Act rights through judicial/administrative proceedings or private investigations and to conduct public education and outreach.)
