S. 289 — Youth Poisoning Protection Act

This section declares any consumer product containing a high concentration of sodium nitrite—defined as 10% or more by weight—a banned hazardous product under the Consumer Product Safety Act (15 U.S.C. 2057). It does not apply to (1) commercial or industrial uses not customarily produced or distributed for sale to, use by, or enjoyment of consumers or (2) products qualifying as a drug, device, cosmetic, or food under the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321), including poultry and poultry products, meat and meat food products, and eggs and egg products as defined in specified federal inspection laws. The ban takes effect 90 days after enactment.
