S. 291 — Lower Colorado River Multi-Species Conservation Program Amendment Act of 2025

This section establishes in the Treasury of the United States the Non-Federal Funding Account for the Lower Colorado River Multi-Species Conservation Program (Fund) to hold non-Federal contributions from state parties and interest earnings pursuant to the Lower Colorado River Multi-Species Conservation Program Funding and Management Agreement (dated April 4, 2005). (As background, the program is a habitat conservation plan implemented by federal and nonfederal parties to protect endangered and threatened fish, wildlife, and plant species along 240 miles of the lower Colorado River from Lake Mead to the Souther International Boundary while accommodating water diversions and hydropower generation.) The section (1) directs the Secretary of the Treasury to deposit into the Fund any unexpended non-Federal contributions provided before enactment (transferring such amounts from the general fund within 90 days of enactment) and any contributions provided on or after enactment; (2) makes Fund amounts and interest available to the Secretary without further appropriation for expenditure in accordance with program documents; (3) authorizes investment of excess Fund amounts only in interest-bearing obligations of the United States; and (4) provides that state parties bear no responsibility for investment losses.
