S. 2913 — Protecting Students with Disabilities Act

This section states congressional findings that (1) the Office of Special Education Programs, established under 20 U.S.C. 1402, shall be housed within the Department of Education and administer programs concerning the education of children with disabilities; (2) the Rehabilitation Services Administration, established under section 3 of the Rehabilitation Act of 1973 (29 U.S.C. 702), shall be housed within the Department of Education and administer programs concerning workforce investment activities for individuals with disabilities; and (3) the executive branch lacks unilateral authority to alter this statutory framework. The section reaffirms Congress's intent and ensures compliance with existing statutes.

This section prohibits the use of appropriated funds to (1) eliminate, consolidate, or restructure any Department of Education office that administers or enforces programs serving individuals with disabilities, including under the Individuals with Disabilities Education Act (IDEA) or Rehabilitation Act of 1973; (2) terminate, reassign, or alter responsibilities of personnel in such offices if it results in unmet statutory obligations under those laws; or (3) contract with or delegate to outside entities the administration or enforcement of such programs.
