S. 2935 — Sovereign Enforcement Integrity Act of 2025

This section states congressional findings that the United States is not a party to the Rome Statute establishing the International Criminal Court (ICC); that the federal government has exclusive authority over foreign relations and treatment of foreign nationals in U.S. territory; that arresting or detaining foreign nationals on U.S. soil pursuant to an ICC request or indictment absent federal authorization could jeopardize U.S. foreign policy interests and conflict with constitutional principles; and that international law enforcement activities must follow uniform national standards. The section declares the purpose of the Act to prohibit state and local law enforcement officers from executing, honoring, or enforcing any ICC request, warrant, or indictment unless expressly authorized by federal law.

This section prohibits officers, employees, or agents of a state, territory, the District of Columbia, or any political subdivision thereof from (1) arresting, detaining, or otherwise depriving a foreign national of liberty based solely on a warrant, indictment, summons, or other process issued by the International Criminal Court (ICC); (2) cooperating with or providing assistance to the ICC in effectuating such an arrest or detention; or (3) using any funds, facilities, personnel, or equipment to carry out such actions. The prohibition does not apply if Congress enacts legislation expressly authorizing cooperation with the ICC in a specific case or if the President certifies to Congress that such cooperation is essential to a declared national security interest and issues a specific written authorization.

This section establishes a severability clause, providing that if any provision of the Act, or its application to any person or circumstance, is held unconstitutional, the remainder of the Act and the application of its provisions to other persons or circumstances shall not be affected.
