This section requires the President, through the Director of the Office of Management and Budget (OMB) (in consultation with the Director of the Office of Personnel Management), to reduce the total number of full-time equivalent (FTE) Federal employees across all executive agencies (i.e., Executive departments, Government corporations, and independent establishments, as defined in 5 U.S.C. §105) to no more than 90% of the baseline number as of September 30, 2025, effective beginning in fiscal year 2028. (Thus, executive agencies must achieve an overall 10% workforce reduction from the FY2025-end baseline.) To implement the reduction, the section directs the following: (1) By October 31, 2025, each agency head to report the agency's FTE employee count as of September 30, 2025, to OMB, which by the end of the first quarter of FY2026 must establish agency-specific maximum allowable FTE levels consistent with the overall 90% cap. (2) From the second quarter of FY2026 through September 30, 2027, a replacement ratio limiting agencies to appointing no more than one individual for every three Federal employees who retire or otherwise separate (excluding political appointees). (3) Continuous OMB monitoring of agency compliance from the second quarter of FY2026 through FY2027 (for on-track status) and ongoing from FY2028, with quarterly notices to the President, Congress, and agency heads if any agency exceeds its cap; noncompliant agencies face an indefinite hiring freeze on filling vacancies, remote work expansions, increased remote hours, and additional official time under 5 U.S.C. §7131 until back in compliance. (4) No net increase in service contract procurement unless a cost comparison shows financial advantage to the government. The President may waive the requirements for specific positions or categories during wars, national security concerns, or extraordinary emergencies threatening life, health, public safety, or property. Employee counts are on an FTE basis and unaffected by collective bargaining agreements.
