S. 2951 — Competitive Bidding Relief Act

This section directs the Secretary of Health and Human Services to (1) implement the transition rule in the first sentence of 42 CFR 414.210(g)(9)(v) (or successor regulation)—which adjusts Medicare payment rates for durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) furnished in non-competitive bidding areas—for all applicable items and services in areas other than rural or noncontiguous areas through December 31, 2025; and (2) delay implementation of 42 CFR 414.210(g)(9)(vi) (or successor regulation) for all such areas until January 1, 2026. (As background, the DMEPOS competitive bidding program sets Medicare payment rates in bidding areas based on supplier bids, while non-bidding areas use fee schedules adjusted toward those rates through specified transition rules.)
