S. 297 — PSA Screening for HIM Act

This section states congressional findings on prostate cancer, including that it is the second leading cause of cancer death among U.S. men (with 1 in 44 men dying from it and over 35,700 estimated deaths in 2025), the second most commonly diagnosed cancer (with 1 in 8 men diagnosed in their lifetimes, 3.3 million men living with a diagnosis, and over 310,000 estimated new cases in 2025), near-100% survival if detected early but only 37% if late-stage, few early symptoms, disproportionate incidence and mortality among African-American men (70% more likely to be diagnosed than White men, 1 in 6 developing it in their lifetimes, and 2.1 times more likely to die), elevated risk for men with family history, recommendations for earlier screening discussions for high-risk groups, and higher costs for treating metastatic versus early-stage disease.

This section amends the preventive health services coverage requirement (i.e., Section 2713(a) of the Public Health Service Act, which mandates no cost-sharing for recommended preventive services such as those given an A or B rating by the U.S. Preventive Services Task Force (USPSTF)) to require group health plans and health insurance issuers offering group or individual coverage to cover, without cost-sharing, evidence-based prostate cancer preventive care and screenings for men age 40 and older at high risk (i.e., African-American men and men with a family history of prostate cancer). It defines men with a family history of prostate cancer as those with a first-degree relative diagnosed with, who developed, whose death resulted from, or who has a cancer or genetic alteration associated with increased prostate cancer risk. The section further (1) clarifies that current USPSTF recommendations on breast cancer screening, mammography, and prevention are considered the most current other than those issued in or around November 2009; and (2) states that nothing prohibits plans or issuers from covering additional services or denies coverage for services not recommended by the USPSTF. The amendments apply to plan years beginning on or after January 1, 2025.
