S. 2986 — American Medicine Safety and Security Act

This section establishes restrictions on Food and Drug Administration (FDA) employment, work arrangements, and data access involving foreign countries of concern (i.e., People's Republic of China, Russia, Iran). Specifically, the section (1) prohibits nationals of such countries from FDA employment or performing paid labor or services; (2) requires FDA employees or paid workers with an immediate family member (i.e., mother, father, sibling, or child) who is a national of such a country to report that fact, with immediate termination for failure to report; (3) bars any FDA employee (on or after enactment) from employment or paid or volunteer work with entities based in such countries for 10 years post-employment, requiring existing and new employees to contractually agree to this limitation as a condition of employment; and (4) denies drug or device reviewers access to FDA data outside their own department, division, or office if they have an immediate family member who is a national of such a country or if they previously worked (paid or volunteer) for an entity based in such a country.
