S. 2992 — Gas Can Freedom Act of 2025

This section repeals the Portable Fuel Container Safety Act of 2020 (which required the Consumer Product Safety Commission (CPSC) to promulgate a consumer product safety standard for flame mitigation devices on portable fuel containers) and the Children’s Gasoline Burn Prevention Act (which required the CPSC to require child-resistant spouts and nozzles on portable gasoline containers). It further nullifies any CPSC regulation promulgated under either repealed act and prohibits the CPSC from promulgating any regulation requiring (1) a flame mitigation device in a portable fuel container or (2) a portable gasoline container to conform to child-resistant requirements. (Thus, portable fuel containers are no longer subject to federal mandates for flame mitigation devices or child-resistant features.)
