S. 3005 — Non-Essential Workers Transparency Act

This section establishes reporting requirements for Executive agencies following a lapse in appropriations. Not later than 30 days after such a lapse ends, the Under Secretary (or equivalent) of the affected Executive agency must submit an unclassified report—potentially including a classified annex—to the agency's appropriate congressional committees (i.e., Homeland Security and Governmental Affairs of the Senate, Oversight and Government Reform of the House, and other jurisdictionally relevant committees) and the Director of the Office of Personnel Management (OPM). The report must include (1) total employees (including contract employees) the day before the lapse began; (2) total salaries expended the prior fiscal year; (3) number of furlough-subject employees during the lapse; (4) sum of their annual basic pay rates; (5) number of non-furlough-subject employees; and (6) sum of their annual basic pay rates. Committees must publish the report on their websites within 30 days of receipt, and OPM must consolidate agency reports into a single report and publish it on its website within 60 days after the lapse ends.
