S. 3009 — Preserving a Sharia-Free America Act

This section establishes a new ground of inadmissibility and deportability under the Immigration and Nationality Act (8 U.S.C. 1182(a) and 1227(a)) for aliens who advocate for the imposition of Sharia law in a manner that violates rights under the U.S. Constitution or federal or state law. It directs the Secretary of State, Secretary of Homeland Security, and Attorney General, as applicable, to (1) deny immigration benefits, visas, relief, or admission to such aliens; (2) revoke benefits or visas, deem inadmissible or deportable, and remove aliens in the U.S. determined to have engaged in such advocacy; and (3) revoke benefits or visas, deem inadmissible or deportable, and remove aliens who make false statements to federal officials regarding such advocacy, in violation of 18 U.S.C. 1001(a). Determinations of removability under this section are final and not subject to judicial review.

This section adds two new grounds to the Immigration and Nationality Act related to advocacy of Sharia law that would violate the rights of another person under the U.S. Constitution or any federal or state law: (1) renders inadmissible any alien who engages in such advocacy, as a new subparagraph (F) under INA §212(a)(10) (8 U.S.C. 1182(a)(10)); and (2) renders deportable any alien who engages in such advocacy at any time after admission, as a new paragraph (3) under INA §237(a) (8 U.S.C. 1227(a)). (Thus, such advocacy becomes a basis both to deny visas/admission and to deport previously admitted aliens.)
