S. 3046 — Gang Activity Reporting Act of 2025

This section states congressional findings regarding violent crime and gang activity, including (1) a more than 30% increase in the U.S. murder rate since 2020; (2) gangs' responsibility for an average of 48% of violent crime according to the Department of Justice's 2011 National Gang Threat Assessment; and (3) the need for up-to-date, accurate federal reporting on gang activity to support evidence-based policy.

This section establishes a new section 530E of title 28, United States Code, requiring the Attorney General, in conjunction with the Secretary of Homeland Security and the Director of the Federal Bureau of Investigation, to submit reports on gang activity, reporting, investigation, and prosecution to the Senate and House Judiciary Committees—not later than 150 days after enactment and annually thereafter on the last day of each fiscal year. The reports must cover (1) growth of local, national, and transnational gangs over the 10 fiscal years preceding submission, including numerical data on membership, location, activities, and trends; (2) gangs' tools, methods, networks, cooperation, and associated crimes; (3) state-based reporting issues affecting federal data; (4) agency initiatives over the prior 5 fiscal years to track, investigate, and prosecute gangs, including start/end dates and reasons for termination; (5) federal resources allocated by the Department of Justice, Department of Homeland Security, and Federal Bureau of Investigation to gang-related efforts; (6) prior fiscal year gang enforcement statistics, including arrests (compared to the prior 5 fiscal years), juvenile arrests, and firearms seized (including from juveniles); (7) agency data collection procedures; and (8) changes to those procedures in the prior 18 months, with explanations. Reports or portions thereof may be classified as determined appropriate by the agency heads. This section also makes a conforming amendment to the table of sections for chapter 31 of title 28, United States Code.
