This section repeals Section 304 of the Clean Air Act (42 U.S.C. 7604), which authorizes citizen suits against the EPA Administrator for failure to perform nondiscretionary duties and against persons alleged to violate emission standards, limitations, orders, or other CAA requirements. (Thus, such suits are no longer available.) It also makes conforming amendments to multiple CAA provisions—including Sections 112 (hazardous air pollutants), 113 (enforcement), 119 (vapor recovery), 129 (solid waste combustion), 169A (visibility protection), 176 (conformity), 202 (vehicle emissions), 317 (economic impact assessments), 328 (small business stationary sources), and 411 (Phase II sulfur dioxide allowances)—and to the American Innovation and Manufacturing Act of 2020 to remove cross-references to Section 304.
