This section prohibits payment of salary to Members of Congress (i.e., Senators, Representatives, Delegates, the Resident Commissioner from Puerto Rico, congressional leaders, and the Speaker of the House) during a government shutdown (i.e., lapse in appropriations for one or more federal agencies or departments), prorated by excluding one day's pay—based on the applicable annual rate under 2 U.S.C. 4501—for each 24-hour period of shutdown in a pay period. It requires the payroll administrators of each chamber (Secretary of the Senate or Chief Administrative Officer of the House) to implement the pay exclusion after the regularly scheduled federal general election in November 2026; prior to that date (from enactment through the election), withhold equivalent amounts in escrow and release them on that date (to avoid varying compensation during a congressional term in violation of the 27th Amendment). It directs the Secretary of the Treasury to assist the payroll administrators.
