S. 307 — Prison Staff Safety Enhancement Act

This section states congressional findings regarding inmate-on-staff sexual harassment and assault in the Federal Bureau of Prisons (BOP), based on a 2023 Office of the Inspector General report evaluating BOP efforts from FY2015 to FY2021. The findings are that (1) such incidents are widespread; (2) BOP does not collect adequate data and thus cannot identify their full scope; (3) BOP lacks systems to evaluate mitigation strategies; and (4) BOP has not implemented the report's recommendations to improve data collection and mitigation.

This section requires the Bureau of Prisons (BOP) to fully implement each recommendation in the Department of Justice Inspector General's 2023 report, "Evaluation of the Federal Bureau of Prisons’ Efforts to Address Sexual Harassment and Sexual Assault Committed by Inmates Toward Staff," not later than 90 days after enactment of this Act and, if unable to do so, to submit a report to Congress explaining the failure and providing a timeline for implementation. Not later than one year after full implementation, the Inspector General must obtain from BOP updated data on sexual harassment and sexual assault incidents (as defined by reference to 10 U.S.C. §920(b)-(d)) perpetrated by incarcerated individuals against correctional officers or other BOP employees during FY2022-FY2025, analyze the data (including punishments imposed in BOP facilities during the prior five years), and submit the analysis and any additional recommendations to Congress and the Attorney General. Not later than one year after receiving that analysis, the Attorney General must promulgate regulations establishing national standards for preventing, reducing, and punishing such incidents.
