S. 3079 — Armed Forces Pay Act of 2025

This section provides continuing appropriations for FY2026, out of any money in the Treasury not otherwise appropriated, for any period without interim or full-year appropriations, to (1) members of the Armed Forces (including reserve components performing active service or inactive-duty training) and (2) civilian employees of the Department of Defense, Coast Guard, Office of the Director of National Intelligence, and Central Intelligence Agency. (Thus, these personnel receive pay and allowances during a potential funding lapse.)

This section limits the availability of appropriations, funds, and authorities provided under this Act (pursuant to section 2) to the earliest of (1) enactment of an appropriation (including a continuing appropriation) for those purposes, (2) enactment of an applicable regular or continuing appropriations resolution or other Act without appropriation for those purposes, or (3) September 30, 2026.

This section deems funds appropriated or transferred by this Act for intelligence activities and intelligence-related activities to be specifically authorized by Congress for purposes of 50 U.S.C. 3094 during FY2026 until enactment of the Intelligence Authorization Act for FY2026. (As background, 50 U.S.C. 3094 generally requires specific congressional authorization before intelligence agencies may obligate or expend appropriated funds for such activities, subject to limited exceptions for reprogramming.)
