S. 3100 — POST Act of 2025

This section directs the Director of the Federal Protective Service (FPS), not later than one year after enactment, to establish processes strengthening oversight, performance, and accountability of contract security personnel protecting buildings owned, occupied, or secured by the General Services Administration Public Buildings Service (GSA PBS). Those processes require the Director to (1) establish standards for collecting, maintaining, and analyzing covert testing data (i.e., undercover assessments of security effectiveness); (2) conduct quarterly analytical reviews of that data to identify trends and deficiencies across GSA PBS facilities; (3) direct the security contractor to implement cause-specific corrective training and performance improvement plans for personnel failing covert tests and to review the contractor's plans; and (4) develop updated security training guidance reflecting covert testing findings, emerging threats, and best practices. Upon completing those activities, and annually thereafter, the Director must report to the House Committee on Transportation and Infrastructure and the Senate Committee on Homeland Security and Governmental Affairs on implementation, challenges, and legislative recommendations.

This section directs the Director of the Federal Protective Service, not later than 180 days after enactment, to (1) conduct a comprehensive evaluation of the personnel tracking system used to manage contract security personnel deployment availability; (2) determine whether to replace the system with a more reliable platform, including private sector solutions, or to implement corrective actions such as technical, operational, or administrative fixes; and (3) develop and publish an implementation plan that includes timelines for completion and procedures for communicating personnel shortages, absences, or security coverage gaps to building tenants. It further requires the Director to submit reports to the Senate Committee on Homeland Security and Governmental Affairs and the House Committee on Transportation and Infrastructure not later than one year after enactment, and annually thereafter for three years, detailing the determination under (2), implementation actions, tenant communication effectiveness, and recommendations for additional legislative or administrative actions.

This section provides a savings clause clarifying that nothing in this Act designates an employee of a Department of Homeland Security contractor engaged in protecting federal property under 40 U.S.C. §1315 as a federal employee. (Thus, such contractor employees retain their non-federal status notwithstanding any other provision of the Act.)
