S. 3109 — TRAFFIC Act of 2025

This section prohibits issuance of specified transportation-related licenses, certificates, and documents to individuals convicted of an offense under chapter 77 of title 18, United States Code (i.e., federal human trafficking, peonage, or slavery offenses), or a substantially similar offense under other federal, state, local, or tribal law. Specifically, the section (1) adds denial authority for merchant mariner licenses, certificates, and documents (46 U.S.C. ch. 75); (2) bars licensing or certification of locomotive operators (49 U.S.C. 20135); (3) bars certification of train conductors (49 U.S.C. 20163); (4) expands disqualification grounds for commercial driver's licenses, replacing prior restrictions tied to vehicle use in trafficking acts (49 U.S.C. 31310(d)(2)); (5) bars issuance of airman certificates by the Federal Aviation Administration (49 U.S.C. 44703); and (6) requires disqualification from all other relevant Department of Transportation or Department of Homeland Security authorizations for vehicle, aircraft, vessel, or transportation operations.
