S. 3111 — Small Businesses before Bureaucrats Act

This section amends Section 14(c) of the National Labor Relations Act (NLRA) to require the National Labor Relations Board (NLRB), when establishing dollar thresholds for declining jurisdiction over labor disputes involving certain classes or categories of employers (i.e., those with minimal impact on interstate commerce), to increase those thresholds to 10 times their levels as of the day before enactment for calendar year 2026 (from current levels) and adjust them annually thereafter based on changes in the Personal Consumption Expenditure Per Capita Index. (As background, NLRB jurisdictional standards set dollar-volume thresholds by industry—e.g., currently $100,000 for non-retail and $500,000 for retail—to determine NLRA applicability; raising thresholds exempts more small employers from federal oversight, allowing state courts or agencies to handle such disputes.) This section further directs the Director of the Bureau of Economic Analysis to annually publish that index beginning in 2027, reflecting per capita personal consumption expenditures for the prior calendar year. The amendments apply to NLRB jurisdictional decisions made on or after the later of January 1, 2026, and the date of enactment.
