S. 3114 — Union Members Right to Know Act

This section amends Section 105 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA, i.e., the union member bill of rights) to require labor organizations to provide each member with (1) a copy of the LMRDA and a summary of each of its titles, (2) a summary of rights under Title VII of the Civil Rights Act of 1964 to seek religious accommodations not to pay union dues or fees, and (3) a summary of employee rights under Communications Workers v. Beck, 487 U.S. 735 (1988) (i.e., the right of fee payers to object to subsidizing nonrepresentational union activities). Such information must be provided by mail or email—within 30 days to new members joining on or after 90 days post-enactment of the Union Members Right to Know Act, within one year to existing members, and annually thereafter—and, if the union has a website, via a specified homepage hyperlink; unions must certify initial website compliance to the Secretary of Labor within 180 days of enactment and full compliance starting 18 months post-enactment on an annual basis. The section also adds a new Section 106 to the LMRDA prohibiting use of employee dues, fees, or contributions for nonrepresentational activities (i.e., beyond collective bargaining or contract administration) absent written authorization after a 35-day notice period, with initial authorizations expiring after one year and no automatic renewal.
