S. 3115 — NLRB Stability Act

This section amends section 10 of the National Labor Relations Act (29 U.S.C. 160) to (1) prohibit the National Labor Relations Board (NLRB) from issuing an order that conflicts with a decision of the U.S. Court of Appeals for the circuit in which the unfair labor practice is alleged to have occurred (new subsection (n)); and (2) revise venue for judicial proceedings as follows: (a) for Board enforcement petitions under subsection (e), to the court of appeals for that circuit, the U.S. Court of Appeals for the D.C. Circuit, or (if appellate courts are in vacation) a U.S. district court in that circuit or the U.S. District Court for D.C. (previously, any court of appeals where a party resides or transacts business); and (b) for respondent petitions for review under subsection (f), exclusively to the court of appeals for that circuit (previously, any court of appeals where a party resides or transacts business). (As background, the NLRB investigates and remedies unfair labor practices affecting commerce under the NLRA; subsections (e) and (f) govern court enforcement of Board orders and review of those orders, respectively.)
