S. 314 — Hotel Fees Transparency Act of 2025

This section prohibits covered entities from advertising, marketing, or offering prices for covered services—such as hotel rooms and short-term rentals—in interstate commerce without (1) clearly, conspicuously, and prominently displaying the total services price in any advertisement, marketing, or price list; (2) disclosing the total services price to prospective purchasers at the time covered services are first displayed and throughout the purchasing process; and (3) disclosing, prior to final purchase, any tax, fee, or assessment imposed by a government entity, quasi-government entity, or government-created special district or program. Such violations are treated as unfair or deceptive acts or practices under FTC rules (15 U.S.C. 57a(a)(1)(B)) and are enforceable by the Federal Trade Commission (FTC) with all powers, privileges, and immunities under the FTC Act (15 U.S.C. 41 et seq.); state attorneys general may also bring civil actions on behalf of state residents, subject to advance notice to the FTC (or immediate notice if infeasible), FTC intervention rights, and restrictions during FTC actions.
