S. 3151 — National Flood Insurance Program Automatic Extension Act of 2025

This section revises the National Flood Insurance Program's (NFIP) expiration provision—previously prohibiting new flood insurance contracts after September 30, 2023—to establish a contingent automatic extension of program authorities. As background, the NFIP, administered by the Federal Emergency Management Agency (FEMA), enables property owners in participating communities to purchase flood insurance coverage and new policies cannot be written during program lapses. The revision defines a "termination date" as September 30, 2023, or a later date set by another law, automatically extends authorities through the last day of the fiscal year following the terminal fiscal year (i.e., to enter or renew contracts, continue existing coverage, pay claims, service policies, and operate the program) unless Congress enacts an extension or repeal beforehand, and maintains preexisting borrowing limits (under section 1309), funding levels, rates, and terms during the extension period. Explicitly dated pilot programs and similar activities are not extended, existing contracts remain unimpaired, and the revision applies retroactively as if enacted on September 30, 2025.
