S. 3158 — National Defense Supply Chain Integrity Act of 2025

This section exempts determinations by the Secretary of Defense under subsection (a) of Section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (i.e., identifications of Chinese military companies owned or controlled by, or affiliated with, the People's Liberation Army) from Administrative Procedure Act (APA) requirements. (Thus, such determinations are deemed a military or foreign affairs function under 5 U.S.C. §554 and are not subject to APA provisions on rulemaking (5 U.S.C. §§551, 553–559) or judicial review (5 U.S.C. §§701–706).)
