This section establishes a new federal criminal offense at 18 U.S.C. §1522 for obstructing immigration enforcement activities. The offense occurs when a person, after receiving a verbal warning not to approach from a known federal immigration enforcement officer (i.e., any U.S. officer, agent, or employee authorized to prevent, detect, investigate, or prosecute federal immigration law violations) engaged in a lawful duty, knowingly approaches or remains within 25 feet of the officer with intent to (1) impede or interfere with the officer's performance of that duty, (2) threaten the officer with physical harm, or (3) harass the officer (i.e., knowingly engage in a course of conduct intentionally causing the officer substantial emotional distress that serves no legitimate purpose). Violations are punishable by a fine under title 18, imprisonment for not more than 5 years, or both.
