S. 3197 — Flight Risk Reduction Act

This section requires a detention hearing under 18 U.S.C. §3142(f)(1) if the defendant is not a U.S. citizen or lawful permanent resident, in addition to existing bases such as certain violent or narcotics offenses. It further establishes a rebuttable presumption under §3142(e)(4) that no condition or combination of conditions of release will reasonably assure such a defendant's appearance or the safety of any other person and the community, rebuttable only by the defendant's clear and convincing evidence, and specifies that ties to family or employment in the United States do not constitute grounds for rebuttal.
