S. 3201 — Good Government Act of 2025

This section adds a new subchapter IV to chapter 131 of title 5, U.S. Code, to regulate covered financial instruments of Members of Congress and their spouses and dependent children. It (1) defines "covered financial instrument" as any investment in a security, security future, or commodity (as defined in the Commodity Exchange Act), or any comparable economic interest acquired synthetically (e.g., via derivatives such as options or warrants), including those held indirectly through investment funds, non-qualified blind trusts, employee benefit plans, or deferred compensation plans (excluding diversified mutual funds or exchange-traded funds, U.S. Treasury bills/notes/bonds, spousal/dependent child compensation from primary occupation, or government employee retirement plans; an investment is "diversified" if it has no stated policy concentrating in any industry, business, single non-U.S. country, or single-state bonds); (2) prohibits a Member of Congress, spouse, or dependent child from holding, purchasing, or selling any covered financial instrument during the Member's term of service, except as provided in the divestment section; and (3) requires each current Member of Congress (i.e., serving on the date of enactment) to certify to the applicable supervising ethics committee (Senate Select Committee on Ethics or House Committee on Ethics) within 30 days of enactment that all such instruments owned by the Member, spouse, or dependent child will be divested or placed in a qualified blind trust within 120 days of enactment (or certify that none are owned). (Thus, new Members of Congress—those commencing service after enactment—are subject to the prohibition upon beginning service, with no specified grace period.)
