S. 3213 — Destruction of Hazardous Imports Act

This section amends the Federal Food, Drug, and Cosmetic Act (FD&C Act) as follows: (1) in section 801(a), authorizing the Secretary of Health and Human Services to destroy any article refused admission that presents a significant public health concern (in addition to those described under subsection (b)); and replacing "drug or device" with "drug, device, or other article" in the eighth, ninth, and tenth sentences; (2) in section 301, adding new prohibited act (jjj) for the unauthorized movement or introduction or delivery for introduction into interstate commerce, including export, of an article the Secretary has decided to destroy under the seventh sentence of section 801(a); (3) applying these amendments to articles beginning 180 days after enactment; and (4) directing the Secretary, acting through the Commissioner of Food and Drugs, to finalize implementing regulations within 90 days of enactment, consistent with international agreements. (Thus, FDA gains authority to destroy refused food, tobacco products, or cosmetics posing significant health risks, previously limited primarily to drugs and devices.)
