§2.Transfer of land into trust for the 19 Pueblos
This section directs the Administrator of General Services to transfer administrative jurisdiction over approximately 9.89 acres of federal land in Albuquerque, New Mexico—three specified tracts (Tract 1: 3.57 acres with a 76,682-square-foot warehouse; Tract 2: 5.78 acres; Tract 3: 0.54 acres), formerly part of the Albuquerque Indian School and currently under GSA custody—to the Secretary of the Interior not later than 90 days after enactment and relocation of all federal tenants, after which the Secretary shall immediately hold the land in trust for the benefit of 19 specified New Mexico Pueblos (Acoma, Cochiti, Isleta, Jemez, Laguna, Nambe, Ohkay Owingeh, Picuris, Pojoaque, San Felipe, San Ildefonso, Sandia, Santa Ana, Santa Clara, Santo Domingo, Taos, Tesuque, Zia, and Zuni).
The section further (1) requires the Secretary to obtain a survey of the land (based on a specified May 2023 plat), make minor corrections as needed, and record it in Bernalillo County records; (2) subjects Tract 1 to a GSA-determined easement for retrieving or relocating federal property; (3) restricts land use to the Pueblos' educational, health, cultural, business, and economic development, subject to federal laws applicable to Indian trust land in New Mexico; (4) preserves all private or municipal encumbrances, rights-of-way, restrictions, easements of record, or utility agreements in effect on the date of enactment; and (5) prohibits class I, II, and III gaming (as defined in the Indian Gaming Regulatory Act) on the land.
