This section prohibits the President, on or after the date of enactment, from imposing any duty or tariff-rate quota on an article of food unless (1) the President transmits a request to Congress and (2) Congress enacts a joint resolution of approval. The limitation does not apply to antidumping or countervailing duties under title VII of the Tariff Act of 1930. Joint resolutions of approval—the matter after the resolving clause of which approves the duty or quota with respect to a described article of food, identifying the submission date—may be introduced in either house by any member within 45 days of the President's request and are subject to expedited procedures under 19 U.S.C. 2192(b)-(f) (i.e., referral to Ways and Means or Finance, discharge motions after 30 days, privileged consideration, and one hour of debate). This section defines "article of food" to include (1) food for use, (2) products chiefly used as food for animals or ingredients therein, (3) agricultural commodities as defined in 7 U.S.C. 5602, (4) packaging or containers for such articles, and (5) seeds, fertilizers, manures, and agro-chemicals.
